The Independent says it has a 135 page document prepared by BBC lawyers, which challenges the Hutton Report.
The document is said to identify numerous areas where the lawyers believe Lord Hutton ignored evidence and misinterpreted the law.
The Independent says Governors decided to reject the advice and instead issued the apology that Downing Street and Alastair Campbell were demanding.
